Wobbly rear end (lateral suspension issue)

Not sure if I have the same issue or not, I don't have adaptive dymanics, but the rear of my car does appear and feels very loose going over uneven roads, I get a lot of squeaks and if you sit in the rear seats you can see the tailgate moving in its opening, it is like there isn't enough structural integrity in the rear to prevent the movement. The dealers did try to adjust the tailgate to shut "tighter" but this had no effect.
 
Just picked it back up from the dealer after they had it for more than two weeks. They fixed the ictp connection problem with a new telemetry? Unit. But if anything the squeaks, rattles and groans are worse. I'm not sure what to do next. Part of me has doubts that I may be being too picky, but the noises and feel of this car is far worse than I had in my 10 year old freelander. I think I need an extended test drive in another f-pace to compare how the rear end feels and sounds. The dealership just doesn't seem to be set up to find all of the noises I get just driving 10 miles.

Does anyone have any suggestions on how to escalate this, after driving home tonight I am considering getting them to buy the car back, but now that it's more than 6 months old I think I will end up losing a considerable amount of cash.
