Hi a bit a advice required before I speak to my dealership this week
I have paid my £1000 deposit on a new f pace back in July '16 for delivery in Nov / Dec '16 on a 2.0 portfolio , ammonite met grey with black leather interior and a bag full of other options including the cup holder cover.
Unfortunately last week I had a nasty accident which required reconstustive knee surgery leaving me unable to drive for 3 months and 5/6 months off work .
As I'm self employed this will have a dramatic effect on our family cash flow .
Would anyone know if Jaguar offer deposit refunds or am I able to sell on my deposit to another new purchaser . I presume Jaguar would delay delivery of my car but to be honest in 6 months time i will have various other finincial commitments to prioritise before purchasing a new car ;)
Many thanks in advance for your comments and advice

Yes I agree, given the waiting list id say they will refund, especially in your circumstances

Given your issues and its not like they can not see this I am sure they can cancel the order and refund you in full, the car will not have hit the build sheet yet unless the delivery date is brought forward, I would get on the phone and cancel.

Your get your deposit back in full for sure.

Sorry to learn about your misfortune. My dealer would refund the deposit even without the extenuating circumstances you are facing.

I wish you well with your recovery and hope your dealer plays fair. We look forward to you joining the F-Pace Club a bit later than planned then.

If your order isn't locked in there is no car to cancel so you'll easily get your refund. My deposit was placed in Sept 2015 for a lock in 10th June 16. Once locked the car becomes physical so deposits may be more difficult to back out from, especially if odd colour combo or a very high spec.

How very wrong you all were !! Sales manger has just answered my request to cancel with the following response . Very disappointed but won't be leaving it there !!!

Ref: Cancellation of order for Jaguar F-Pace
Order Number: 1523873

As per your email regarding you wish to cancellation the order you placed with us on the 23rd July 2016. We write to accept your cancellation of the order under our terms and conditions as outlined in section 9 of your signed order form - see attached.

As there is no exception as provided by law, or under clauses 9(i),(iv) or 23 of the terms and conditions you will forfeit your £1000.00 deposit paid on the 23rd July 2016, as this clause regarding a refund "does not apply where the vehicle has been made to your specifications or has been personalised". We will however not strictly enforce our indemnity rights regarding your cancellation of the order for compensation (including all costs we may incur) as a result of your cancellation.

I would like to add that on a personal note both I and your Sales Specialist Neil are sorry to hear that your personal circumstances have resulted in you having needed to cancel your order with us.

Yours sincerely

Paul Blunt

I Agree, may be best to contact customer services! not exactly cricket is it? Although from a contract law perspective they are entirely entitled to keep your deposit - cancelling your order is a breach of contract on your part - although like i said, not exactly cricket when they could easily sell the thing!

Thats disgusting, I was under the impression that you could have a full refund providing your order hadn't gone to lock down

I was told by my dealer I could cancel at any point before delivery for a full refund.

The way you are being treated is abhorrent, particularly given your car is not built and your situation.

That is outrageous, and they will probably sell your slot tomorrow to a punter who walks in and wont even offer him the £1000 discount!!!
Bloody cheek I say for a car on back order!!!

I would pick up the phone and speak to Jaguar, as the car has not even been built or allocated a build slot it would be a matter of pressing cancel and the orders all move along one place.

I would not just accept that.

Who were the dealers and where?

I'd suggest your dealer has rather shot himself in the foot with his T&Cs. :

"does not apply where the vehicle has been made to your specifications or has been personalised"

Your vehicle has not yet been "made", so I'd press him further, before embarrassing him to Jaguar and on this forum.

Just been told by the sales manager that the supply / demand situation is media hype and don't believe all I read and they have three F Paces in the showroom to sell to someone today . Actuality their attitude was disgusting and rude . Never even returned my call this week, just an email and then disputed i tried to call him and said all calls are recorded so going to check records . I hope he checked the records properly so they can see for themselves how incompetent they are !!!
Funny how nice they are when there after you money .

Yes it is Mr Paul Blunt ( Sales Manager ) at HA Fox Preston who seems to have this excellent customer service attitude .
Oh Ok, know the group.

Well I know what I would be doing, onto Jaguar explaining the situation and why a Sales Manager and company representing the Jaguar brand has this attitude towards what was a potential customer and maybe after your situation is resolved a future customer.

I have heard the Southampton branch is no better, when I was looking a friend who brought a car from them in Southampton said they were nice as pie all the time they had the order but he had some issues with the car and they did not want to know, a dealer local to me picked up the issues and resolved them and he has just placed an order for the F-type SVR with them and not HA Fox who are local to him so I am not surprised.

Get on the phone to Jaguar.

As you've thoughtfully provided his name and email address on here, there might be a fair number of members and visitiors to this forum who would like to email Paul Blunt directly and tell him what they think of him and his dealership's tactics in this matter. Maybe copy in Customer Relations/Customer Services at Jaguar while you're at it too, their email is: [email protected] . . . also Nathan Harvey, the Digital Case Manager at JLR, email: [email protected] . . if good sense is in short supply, maybe the pressure of getting 'bad press' on social media will help focus their minds. Just a thought.

Good luck FpaceGuy, hope your situation resolves. Keep your temper and stay polite, but be firm. What they are doing is quite appalling and shameful.

Ok, I have a potential solution for you... I had an issue with a dealership who would not lend me a car...

I went on the JLR website, started to spec a car, and live chat came up... I explained, named and shamed the person, and that exact individual phoned me literally within 5 minutes, on a sunday afternoon, to defend the indefensible, and funnily enough I had the exact car I wanted (an Evoque Premium Lux with pano) made available for 24hrs on the following Tuesday.

They HATE being named at JLR as they have a "league table" type complaints system apparently
